Hourly College Counseling Terms of Service
My Odyssey Guide LLC
By purchasing college counseling services from My Odyssey Guide LLC (“My Odyssey Guide,” “we,” or “Consultant”), the purchasing parent, guardian, student, or other responsible party (“Client”) agrees to the following terms.
1. College Counseling Services
My Odyssey Guide provides independent college counseling and educational consulting tailored to the individual student. Depending on the student’s needs and the services requested, counseling may include:
1. Guidance regarding admissions timelines and decision-making
2. Extracurricular activities
3. Evaluation of academic background, interests, goals, and college preferences
4. College research and development or refinement of a college list
5. College admissions and application strategy
6. Standardized testing strategy and planning
7. Planning for college visits and interviews
8. Guidance regarding application forms and requirements
9. Review of applications, excluding essays
10. Guidance regarding extracurricular activities and applicant positioning
11. General discussion of college costs, financial aid, scholarships, and funding considerations
12. Other college-planning matters mutually agreed upon by the Client and Consultant
Services are advisory in nature and will be provided professionally, ethically, and with the student’s interests at the center of the process.
2. Hourly Engagement and Prepayment
Services are purchased on a prepaid hourly basis.
Time is used and accounted for in 30-minute engagement units. Services may include scheduled meetings as well as other work requested or authorized by the Client, such as research, application review, preparation, and written follow-up.
The amount of prepaid time purchased by the Client will be reflected at checkout and in the Client’s purchase confirmation.
Additional services may be purchased as needed and are subject to My Odyssey Guide’s then-current rates and availability.
3. Prepaid Time, Expiration, and Refunds
Prepaid counseling time may be used for services requested by the Client and accepted by My Odyssey Guide, subject to availability.
Unused prepaid time expires 12 months from the date of purchase, unless otherwise agreed in writing.
A Client may request a full refund of unused prepaid time within 14 days of purchase, provided no services have yet been performed. Once services have begun, amounts paid are nonrefundable, but any remaining prepaid time may be used through the applicable expiration date.
Prepaid time is not transferable to another family or student without My Odyssey Guide’s written approval.
If My Odyssey Guide is unable to provide services for which the Client has a remaining prepaid balance, My Odyssey Guide will refund the value of the unused prepaid time.
4. Services Not Included
Unless separately agreed in writing, My Odyssey Guide does not:
· Write, rewrite, edit, review, or provide substantive guidance on application or scholarship essays
· Complete or submit applications, scholarship applications, or financial aid forms on the student’s behalf
· Provide standardized test preparation
· Write the student’s school counselor recommendation
· Request teacher recommendations or act as the student’s school counselor
· Contact admissions officers to advocate for or promote a student’s admission
· Guarantee admission, scholarships, financial aid, or any other outcome
All application materials are the responsibility of the student. My Odyssey Guide may provide general guidance regarding the application process but does not prepare application materials on the student’s behalf.
5. Student and Family Responsibilities
The student remains responsible for the college application process, including the accuracy and completeness of all information submitted.
Students and families are responsible for:
· Monitoring and meeting application, scholarship, financial aid, and other deadlines
· Scheduling and attending counseling appointments
· Completing agreed-upon action items
· Preparing and submitting applications and required materials
· Scheduling college visits and interviews
· Remaining reasonably responsive to communications
· Reviewing all application materials before submission
· Making final decisions regarding where to apply, enroll, or accept financial aid
Parents and guardians are encouraged to support the student while allowing the student to take an appropriate lead in the process.
6. Appointments and Cancellations
Scheduled appointments should be canceled or rescheduled at least 24 hours in advance.
Appointments canceled with less than 24 hours’ notice, or missed appointments, may be deducted from the Client’s prepaid time. My Odyssey Guide may waive this policy in its discretion for emergencies or other exceptional circumstances.
7. No Guarantee of Admissions Outcomes
College admissions decisions are made solely by colleges and universities.
My Odyssey Guide provides recommendations and guidance based on professional judgment, information supplied by the student and family, publicly available information, and other information reasonably available at the time.
My Odyssey Guide makes no representation, warranty, promise, or guarantee regarding admission, scholarships, financial aid, academic placement, or any other outcome.
8. Financial Information
Any discussion of college costs, scholarships, financial aid, or strategies for paying for college is provided for general educational purposes. My Odyssey Guide does not provide legal, tax, investment, or professional financial advice.
Students and families remain responsible for verifying financial information with colleges, government agencies, financial aid professionals, tax professionals, or other appropriate advisers.
9. Confidentiality and Third-Party Services
My Odyssey Guide will treat information concerning the student and family as confidential and will not intentionally disclose such information except as authorized by the Client, reasonably necessary to provide the requested services, or required by law.
My Odyssey Guide may use third-party technology and service providers to deliver its services, including scheduling, communications, document-sharing, payment, research, and other software platforms. Information may be shared with these providers when reasonably necessary to provide services.
Third-party services are governed by their own terms, privacy policies, and security practices. My Odyssey Guide is not responsible for the availability, accuracy, security, or conduct of independent third-party services to the extent permitted by law.
10. Limitation of Liability
To the fullest extent permitted by applicable law, My Odyssey Guide’s total liability arising from or relating to the services purchased shall not exceed the amount actually paid by the Client for the services giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.
11. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Any legal action arising from these Terms or the services provided shall be brought in a court of competent jurisdiction in the State of New York, subject to applicable law.
12. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
A failure by My Odyssey Guide to enforce any provision of these Terms does not waive its right to enforce that or any other provision in the future.
13. Acceptance
By completing the purchase, Client acknowledges that Client has read, understood, and agrees to these Hourly College Counseling Terms of Service.
